Terms of Service

All characters and interactions on talkaicompanion.com are entirely AI-generated. Characters are designed for entertainment purposes only and do not reflect reality, real individuals, or factual advice. Companions (such as Arya, Aarohi, Kabir, Mira, Noor, Ruhi, Gojo Satoru or others), story characters, narrators, voices, images, and every message they produce are generated by artificial intelligence. No character is a real person. Nothing a character says is authored, endorsed, verified, or approved by the Operator as truthful.

Do not take any statements, suggestions, opinions, or simulated conversations from AI characters seriously. AI output may be inaccurate, illogical, inconsistent, repetitive, or offensive, and may contradict itself. The Operator is not liable for any real-world decisions, actions, or omissions made based on AI outputs. If an AI character says something that sounds like advice, it is fiction — not advice.

Any resemblance of characters or story events to actual persons, living or dead, or real events, is entirely coincidental and unintentional. Character names and personalities are fictional constructs produced for entertainment.

The Service is strictly for users aged 18 years or older. By using the Service you represent and warrant that you are at least 18 years of age. Minors are prohibited from using the Service in any form. If we learn that a user is under 18, we reserve the right to terminate their access immediately without notice.

You are responsible for ensuring that minors in your household or using your device cannot access the Service. The Operator is not responsible for verifying the age of users beyond the self-declared age confirmation, and you acknowledge that age verification on the internet cannot be made foolproof.

The Service may include AI-generated adult (18+) content, including "spicy mode" and other mature themes, language, and simulated romantic or suggestive interactions between you and fictional AI characters. Such content is fictional, AI-generated, and intended solely for adult entertainment.

Access to mature content is limited to users who have paid to unlock it, but its availability does not obligate the Operator to produce any specific content. All mature content is your personal choice to enable and consume — at your own discretion and own responsibility. If such content offends you or is illegal in your jurisdiction, you must stop using the Service immediately.

AI can and does make mistakes. The Service relies on machine-learning models that generate content probabilistically. Outputs may be factually wrong, nonsensical, harmful, one-sided, or unsuitable for any particular purpose. The Operator does not pre-screen, review, or guarantee any AI-generated output, and does not guarantee uninterrupted or error-free service.

The Service is not a substitute for professional advice of any kind — including medical, psychological, psychiatric, legal, financial, or relationship advice. AI characters are not therapists, doctors, lawyers, counsellors, or crisis workers. Never rely on the Service for emergency or urgent situations. If you are in crisis, contact local emergency services or a qualified professional. Your use of the Service and any reliance on AI output is entirely at your own risk and responsibility.

You accept and acknowledge this warning as a condition of using the Service. The Operator shall not be liable for any loss, exposure, or damage arising from information you voluntarily enter into the Service. See our Privacy Policy for what is collected and how it is handled.

You may use the Service as a guest (name only) or create an account (username + password). You are solely responsible for: the accuracy of the information you provide; maintaining the confidentiality of your password; and all activity that occurs under your account or guest session. Guest sessions are identified by a device cookie — clearing browser data or switching devices may make a guest session (and its chats and credits) unrecoverable. That risk is yours.

The Operator will not recover, merge, or restore lost guest data, and is not liable for data loss caused by cleared cookies, uninstalled browsers, device changes, or failure to create an account. Passwords are stored hashed; however, given Clause 5, never reuse a password from any other service here.

The Service uses a virtual credit system. Credits and plans (credit packs, unlimited plans, spicy unlocks) are licenses to access features — they are not money, have no cash value, are non-transferable, and are non-refundable except at the Operator's sole discretion (see Clause 8). Credits never expire, but the Operator may adjust pricing, grant rates (including the daily free-credit refresh), features, or credit costs at any time.

Payments are processed in Indian Rupees (₹) via UPI through a third-party payment hub (payment.namansoni.in). Free promotional credits (guest bonus, signup bonus, daily refresh) are grants, not entitlements, and may be modified or discontinued at any time.

India-only payments: the Service's payment and top-up system is provided for users in India only. If you access the Service from any country other than India, you receive no payment support of any kind, and any payment you attempt from outside India is made entirely at your own risk with no assurance of delivery, support, or refund. There is no obligation on the Operator to support non-India payments.

Your money is your responsibility. Please verify the plan, amount, and UPI details before paying. The Operator is not a bank, wallet, or payment intermediary and does not hold user funds. Payments flow through the third-party payment hub; the Operator is not responsible for failures, delays, downtime, or errors caused by UPI apps, banks, or the payment hub.

If a reward (credits, plan, or unlock) was not delivered after a successful payment, you may request a review by contacting:

When you contact support, include your username, payment screenshot, UPI reference / transaction ID, and the plan you purchased. Requests without proof of payment may not be processed. Delivery review and refunds (where granted) may take time and are subject to verification from the payment hub's records.

Refunds will not be provided for: credits already consumed; dissatisfaction with AI-generated content; accidental purchases; changes to free credit grants; accounts terminated for violating these Terms; or payments made from outside India. Nothing in this clause creates a right to a refund; it only describes how to request one.

By using the Service, you agree NOT to:

• • use the Service if you are under 18 years old;
• • enter confidential, proprietary, or highly personal information (passwords, financial data, government IDs) into chats — this is strictly prohibited (Clause 5);
• • use the Service to plan, encourage, or carry out any illegal activity under Indian law or the law of your jurisdiction;
• • harass, threaten, stalk, or attempt to extract real personal data from other users (if any user-facing surfaces exist);
• • attempt to identify, doxx, or claim that any AI character is a real person;
• • use the Service to generate or distribute content that sexualizes minors, promotes self-harm, terrorism, or violence;
• • reverse-engineer, scrape, automate, bot, or overload the Service, or bypass paywalls, rate limits, or credit metering;
• • resell, share, or commercially exploit access to the Service or its content;
• • impersonate the Operator or misrepresent your affiliation with the Service.

The Operator may suspend or terminate access immediately, without notice or refund, for any conduct it reasonably believes violates these Terms or is harmful to the Service or its users.

You are solely and fully responsible for everything you type, say (including voice), or generate into the Service ("User Input"). The Operator does not endorse, adopt, or take responsibility for User Input. You grant the Operator a non-exclusive, worldwide, royalty-free license to store, process, and use User Input solely to operate and maintain the Service (including AI context and memory features).

You represent that you have the rights to any User Input you provide and that it does not violate any law or third-party right. Do not submit content you would not want stored: remember Clause 5 — chat histories are logged and stored, and are not encrypted at rest.

The Service — including its code, design, branding, companion and story content (excluding User Input), AI prompt systems, and marketing materials — is owned by the Operator and protected by applicable intellectual-property laws. Fan-inspired characters (e.g., inspired by existing franchises) are unofficial parody/fan-content, are not affiliated with or endorsed by any rights holder, and remain the property of their respective owners.

You receive a limited, revocable, non-transferable, non-exclusive license to access and personally use the Service. No other rights are granted. All rights not expressly granted are reserved by the Operator.

The Service is provided on an as-available basis. The Operator may modify, suspend, limit, discontinue, or shut down any part of the Service (including companions, stories, features, credits, free grants, or payment options) at any time, with or without notice, and shall bear no liability for doing so. Downtime, maintenance, model changes, and content changes may occur.

You may stop using the Service at any time. The Operator may terminate or restrict your access at any time for any reason, including suspected violation of these Terms, abuse, or legal compliance. On termination, your right to use the Service ceases immediately; remaining credits and unlocks are forfeited and are not refundable.

THE SERVICE AND ALL ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, SECURITY, OR UNINTERRUPTED OPERATION. THE ENTIRE RISK OF USE, RESULTS, AND PERFORMANCE OF THE SERVICE IS WITH YOU.

No advice or information given by the Operator or any AI character creates any warranty not expressly stated in these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, PRIVACY, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, AI-GENERATED CONTENT, PURCHASES, DATA EXPOSURE, OR THESE TERMS — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO THE OPERATOR (IF ANY) IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. BECAUSE SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, PARTS OF THIS CLAUSE MAY NOT APPLY TO YOU; IN THAT CASE LIABILITY IS LIMITED TO THE FULLEST EXTENT SUCH JURISDICTION ALLOWS.

You expressly acknowledge and assume all risks associated with using the Service, including but not limited to: exposure to AI-generated content that may be unexpected, offensive, or mature; the storage of your chats in unencrypted form; errors and mistakes in AI output; the emotional attachment or distress that may develop toward fictional AI characters; financial risk from voluntary purchases where refunds are not guaranteed; and service changes or discontinuation.

To the maximum extent permitted by law, you hereby release, waive, and discharge the Operator from any and all claims, demands, or causes of action arising out of or related to your use of the Service, whether known or unknown, including those caused by the Operator's ordinary negligence, except where such release is prohibited by law.

AI companions are entertainment software — they are not humans, not friends in the legal sense, not therapists, and not a replacement for real human relationships or professional help. Maintaining your real-world wellbeing, relationships, and finances is your responsibility alone.

You agree to defend, indemnify, and hold harmless the Operator and their affiliates, service providers, and (where applicable) partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your User Input; (b) your use or misuse of the Service; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) your breach of the data-security prohibitions in Clause 5.

The Service relies on and links to third-party services, including the payment hub (payment.namansoni.in), UPI/banking systems, and AI model providers. The Operator does not control these third parties and is not responsible for their content, availability, security, privacy practices, or failures. Your use of third-party services is governed by their own terms, and any dispute with them is solely between you and them.

The Operator may update these Terms at any time by posting the revised version on this page and updating the "Last updated" date. Material changes may additionally be surfaced in-app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. It is your responsibility to review this page periodically. If you do not agree with the updated Terms, you must stop using the Service.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute shall first be raised in good faith via the support channels (support@namansoni.in or payment.namansoni.in/#support), and the parties shall attempt resolution for a reasonable period before pursuing legal remedies, which shall be subject to the exclusive jurisdiction of the competent courts of India.

If any provision of these Terms is found invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect. The failure of the Operator to enforce any right or provision is not a waiver of that right.
